Privacy Policy (Updated October 2010)

Please read this Privacy Policy carefully before using the Site.

The American Podiatric Medical Association (“APMA”) is committed to protecting the privacy of its members and others who use this website, located at http://www.apma.org/, or any website owned or controlled by APMA (collectively referred to as the “Site”). This online privacy policy (“Privacy Policy”) describes how information is collected and used. This Privacy Policy applies only to information collected by APMA via the Site.

By using this Site, you agree that any information you submit via the Site may be used in accordance with this Privacy Policy, as it exists at the time of your visit. You also agree to abide by any other applicable terms, such as those contained in the Site's User Agreement.

We reserve the right to modify, alter, or otherwise update this Privacy Policy at any time and for any reason. You should visit this page from time to time to review the current terms. To assist you in knowing when the Privacy Policy was last updated, the month and year of the most recent updated policy will appear at the top of this page. In the event APMA makes a material change to the Privacy Policy, we will notify you by e-mail (to the e-mail address we have on file) or by posting a notice to the Site.

I. Information Collection for Users Over the Age of Thirteen

For the purposes of this Privacy Policy, the term “personally identifiable information” is information that identifies you personally, such as your name, address, telephone number(s), e-mail address, or company name. We do not collect personally identifiable information about you except when you voluntarily provide it to us. Please note that in order to receive some benefits or participate in some activities, it will be necessary for you to provide this information. For example, if you request brochures, you will need to provide your mailing address so that we can send them to you. If you become a member via the Site, we may collect your name and billing information in order to process this request. The type of product or service that you seek will determine the personally identifiable information that is collected.

"Non-Personally Identifiable Information" can be technical information or it can be demographic information, such as your age, gender or interests. Non-personally identifiable information does NOT identify you personally. Here are some examples of the non-personally identifiable information that is collected via the Site:

  • Internet Protocol (IP) address -- Your IP address is a number that lets computers attached to the Internet know where to send you data -- such as the webpages you view. We use this information to deliver our webpages to you upon request, to tailor our Site to the interests of our users and to measure traffic within our Site.
  • Cookie -- A "cookie" is a small text file that may be used to collect information about your activity on the Site. For example, when someone visits a page within the Site, a cookie is placed on the user's machine (if the user accepts cookies) or is read if the user has visited the Site previously. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but if you do, you may not be able to take advantage of the personalized features enjoyed by other users to our Site. Some of the cookies we use may be flash cookies or Adobe cookies. While they are harmless, they may contain non-personally identifiable information and, depending on your browser, these cookies may not normally be deleted when your cookies are deleted. Please check your browser to determine where these types of cookies are stored and how they may be deleted.
  • We may collect aggregate survey data, such as statistical data on conditions relevant to the APMA. 
  • We also may collect demographic information to identify the type of visitors we have to the Site, and what pages on the Site are most popular.

We collect the above non-personally identifiable information from all visitors to our Site. If you do not want APMA to have access to this non-personally identifiable information, please do not visit our Site.

II. Information Use for Users Over the Age of Thirteen

We use your personally identifiable information and non-personally identifiable information that is collected on the Site primarily for the following purposes:

  • To deliver services, such as information, newsletters or other content that you request;
  • To alert you to special offers, promotions, updated information and other new services from APMA, its members, or our affiliates;
  • To complete a transaction or service requested by you;
  • To fulfill the terms of a promotion;
  • To ensure the Site is relevant to your needs;
  • To help us create and publish content most relevant to you;
  • To notify you about a material change to this Privacy Policy or the User Agreement, if necessary;
  • To allow you access to limited-entry areas of the Site; and
  • To contact you in response to sign up forms such as Contact Us .

Non-personally identifiable information is used as described above and in other ways as permitted by applicable laws, including combining non-personally identifiable information with personally identifiable information (except with respect to non-personally identifiable information collected from children age thirteen or under).

III. Sharing and Disclosure of Information for Users Over the Age of Thirteen

We may share or disclose your information in the following instances:

(1) We may rent, sell or share your mailing address and name with partners or third parties we believe may be of interest to you. These third parties are prohibited from using this information for any other purpose than the one specified in the applicable use agreement.

(2) We may, for the purpose of recruitment and retention activities only, provide your personally identifiable information, including your e-mail address, to recognized component and affiliated organizations. If you do not want us to share your personally identifiable information in this manner, please do not provide us with this information or request that your e-mail address be removed from all lists and/or from APMA’s database by calling 1.800.ASK.APMA.

(3) We may share your information in order to fulfill a service to you. For example, if you are a member of the Site, we may use your information to provide you with membership services and information. In addition, if you e-mail us a question, we may use your e-mail address to process your request and respond to your question. Also, if you are entering a sweepstakes or contest, we may use your personally identifiable information in order to fulfill the terms of that promotion. This means that we may share the information for prize fulfillment purposes or mail carriers. We also may share your information with the co-sponsor of that promotion.

(4) We may share your information with unaffiliated third-party service providers, agents or independent contractors who help us maintain our Site and provide other administrative services to us (including, but not limited to, order processing and fulfillment, providing customer service, maintaining and analyzing data, sending customer communications on APMA's behalf, and entry collection, winner selection and prize fulfillment for contests, sweepstakes and other promotions). We seek to ensure that these unaffiliated third parties will not use the personally identifiable information for any other purpose than to provide the administrative services for which they are responsible. Because such unaffiliated third-party service providers that help us administer our Site will have access to users' personally identifiable information, if you do not wish for our unaffiliated third-party service providers to have access to your information, please do not register or submit any personally identifiable information to us.

(5) We may share your information to comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property or act in urgent circumstances to protect the personal safety of our end users.

(6) We may share your information with third parties as part of any reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.

(7) We may share your information to track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and provide such information to third parties, such as third party statisticians for the analysis of the data. 

(8) In order to protect against potential fraud, we may verify with third parties the information collected from the Site. In the course of such verification, we may receive personally identifiable information about you from such services. In particular, if you use a credit card or debit card to purchase services with us, we may use card authorization and fraud screening services to verify that your card information and address matches the information that you supplied to us, and that the card has not been reported as lost or stolen.

Except as described in this Privacy Policy or at the time we request the information, we do not otherwise use, share or otherwise disclose your personally identifiable information to any third parties. 

IV. E-mails from APMA

APMA sends "transactional or relational e-mail messages," which include, but are not limited to, eNews, informational bulletins, meetings and member benefits announcements, and surveys. You may opt-out of a specific e-mail list by clicking the "unsubscribe" link at the bottom of any e-mail message sent to you from APMA or its component or affiliated organizations.

V. Accessing Your Personally Identifiable Information and Privacy Preferences

We provide you with an opportunity to access your personally identifiable information to ensure it is correct, accurate and current, or to delete your personally identifiable information from our databases. You may request that we delete information collected about you by sending us an e-mail at privacy@apma.org. You also may remove your name from our third party mailing list by calling 1-800-ASK-APMA.

VI. Forums, Chat Rooms and Other Public Posting Areas

Please note that any information you include in a message that you post to any chat room, forum or other public posting area is available to anyone with Internet access. If you don't want people to know your e-mail address, for example, don't include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN CHAT ROOMS, FORUMS AND OTHER PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN CHAT ROOMS, FORUMS AND OTHER PUBLIC POSTING AREAS.

VII. Links

This Site contains links to or from other websites, such as those of APMA members. Please be aware that APMA is not responsible for the privacy practices of other websites. This Privacy Policy applies only to the information we collect on the Site. We encourage you to read the privacy policies and any other terms of other websites you link to from the Site.

VIII. Security

We implement all reasonable security measures to protect the security of your personally identifiable information, both on and off line. If you have any questions about security at this Site, you can send an e-mail to privacy@apma.org.

IX. User ID and Password

Aspects of the Site require the use of a user ID and password. The user ID and password enables APMA to verify your identity and thereby, allows you access to member information and MyAPMA account and prevents unauthorized access.

X. No Guarantee

No data transmission over the Internet can be guaranteed to be 100% secure. Consequently, APMA cannot guarantee or warrant the security of any information you transmit to us, or to or from our online services.

XI. Kids Privacy Notice for Kidszone Site

A. A Note to Kids

APMA encourages you to get permission from your parents before sending any personal information about yourself (such as your name or your e-mail address) over the Internet, to us or to anyone else.

B. A Note To Parents and Legal Guardians - PLEASE READ

This section of the Privacy Policy explains our information collection and use practices online for children who are age thirteen or under, including what we do with information that we collect and with whom we share that information. We ask that you take the time to review our policy so that you can know exactly how we collect and use information from kids, and so that you will know how you can review or request that we delete your child's information. If you ever have any questions or concerns about this policy, please contact us at privacy@apma.org.

XII. What Information We Collect from Children Age Thirteen or Under

APMA operates a website especially designed for children that is located at http://www.apma.org/kidszone/ ("Children's Site"). The following Sections XI – XIV govern the use of all personally identifiable information that is collected from children age thirteen or under. Except as otherwise provided below, the privacy policy corresponding to the Site that is described above applies to the Children’s Site. 

The APMA generally limits its collection of information from kids. When collected, the information is used so that kids can participate in certain activities offered on the Children’s Site.

There are many things to do on the Children’s Site that do not require the collection of personally identifiable information. However, from time to time we may request limited personally identifiable information from kids in order to offer promotions or other activities. Here are some examples of ways that we may collect information from your child:

  • If the child e-mails an inquiry;
  • If the child participates in a game;
  • If the child asks a question; and
  • If the child signs up for a promotion.

If the offered activity involves only a one-time contact with your child, we will request only that the child provide his or her e-mail address and will delete it once the activity is completed. If the activity involves more than one contact with your child, we also will request that your child provide your e-mail address, as a parent or legal guardian of the child. APMA will use your e-mail address to send you an e-mail letting you know about your child's contact and give you an opportunity to opt-out on behalf of your child. Specifically, the email will include details on how you may (i) provide APMA with consent; (ii) prohibit APMA from any further contact with the child; or (iii) delete the child's personally identifiable information. APMA will not collect more information than is reasonably necessary for the child to participate in the activity at issue. If you opt-out, your child will be unable to participate and his/her personally identifiable information will be deleted. Please note: Unless otherwise noted in the e-mail to you, if we do not receive a response from you that declines subsequent contacts and requests that we delete your child's information, your consent to your child's requested activity will be presumed.

If we become aware that we have inadvertently received personally identifiable information from a user who is age thirteen or under, other than in a legally permissible situation, we will delete the information from our records as soon as we discover it.

As a parent or guardian, you may exercise your right to have you and your child's information deleted at any time. Additionally, you may review your child's personally identifiable information at any time. See Parents' Rights below.

We will not condition participation in any online activity on disclosure by kids of more information than is reasonably necessary to participate.

XIII. How We Use Information We Collect from Children Age Thirteen or Under

When we collect personally identifiable information from children who are age thirteen or under, we will only use that information for the express purpose for which it was collected, such as answering a question or entering your child in a promotion.  The information will not be used for any purpose and the information will be deleted after the activity is complete.

Except as provided in the next paragraph, we do not share information collected from children who are age thirteen or under with any third parties.

Additionally, in the unlikely event that all or substantially all of our assets of the Children’s Site are sold or transferred to another party, all personally identifiable information collected and saved by us may be transferred to that acquiring party. Finally, we may disclose your child's personally identifiable information to third parties in order to comply with law, law enforcement agencies, to protect our rights in or the safety of our Site, or to protect the safety or rights of other users of our Site.

XIV. Cookies and Non-Personally Identifiable Information from Children Age Thirteen or Under

To help make the Children’s Site more responsive to the needs of our visitors, we invoke a standard feature found in browser software, called a "cookie," to assign each visitor a unique, random number -- a sort of anonymous user ID that resides on your computer. The cookie doesn't actually identify the visitor, just the computer that a visitor uses to access our Children’s Site. A cookie cannot read data off your hard drive. We do not link cookie data with personally identifiable information, nor do we store kids' personal information in our cookies. You can disable cookies at any time by changing the preferences in your browser.

Finally, APMA keeps records of certain non-personally identifiable information such as the number of hits a Web page receives, IP address, and other aggregate data. We do not link this aggregate data with any personal information. Third parties that help us administer our websites may have access to this non-personally identifiable, aggregate data, as may our third-party ad servers.

XV. Parent's Rights

We want you to be comfortable with what your child is doing on the Children’s Site. Therefore, you may contact APMA any time regarding privacy questions or concerns, or to request to review the personally identifiable information we have collected from your child. You also may contact us at any time to request that we delete your child's, and/or your personally identifiable information, and/or refuse to permit further collection or use of your child's information. We will take steps to ensure that any person contacting us for a child's information is that child's parent or guardian.
